How Can Social Media Negatively Impact Your Divorce Case?

LawyerTablet

Social media is the bane of most lawyers’ existence. Our clients routinely post inappropriate and damaging content that could put their case in peril. We always caution them to be very careful about what they post on Facebook, as this content can (and will) be used against you by opposing counsel. In this article, the Orlando divorce lawyers at Greater Orlando Family Law will discuss how the misuse of social media can negatively impact your divorce case.

How does using social media impact your marriage?

Social media can destroy marriages. It is always important to respect the privacy of your children and your spouse before posting. If you and your spouse are in an argument, you should not air that dirty laundry on a public forum. Instead, you should discuss the matter with a trusted friend or a therapist. Posting about disagreements is not fair to your spouse. If your relationship does end, anything you post can be used against you during the divorce. So, before you post, think about the impact your post will have on your children and your spouse.

How can social media impact your divorce?

Social media has been known to end marriages. It can also complicate divorces. If you are going through a divorce, it is even more important that you mind your tongue. Any online post you make is admissible in court and can be used as evidence against you. You always want to ask yourself, “What would the judge think about this post?” If the answer is “something bad,” then you’ll want to avoid posting it. In fact, we often advise our clients not to use social media at all during their divorce.

You might also consider going through some of your old posts and deleting them before you engage with a judge in a courtroom. There may be something incriminating there that can be used against you. However, you should be very careful about doing this, as it could be considered evidence tampering. Nothing online ever truly goes away. If opposing counsel learns that you deleted a post, this can also be used against you. They can argue that you’re trying to hide important evidence. The judge might not be pleased.

How can social media impact you post-divorce?

Custody matters can always be revisited. Your former spouse can use their attorney to uncover evidence of moral unfitness against you. If you go out drinking with your friends, be sure to consider the impact that will have on your children and your custody case. You might consider avoiding photos. While pictures of you drinking alone will probably not do too much damage to your custody case, you will want to be very mindful of the impact your posts have on your children.
